Let's say my friend is a gangster. He has a girlfriend who's father doesn't know she's with a gangster. So one day her father catches the two of them having sex. The father tells the gangster that if he doesnt stop seeing his daughter he will threaten to file claims of rape.

Are we talking about forceable rape, or statuatory (below age of consent) rape?

If you are talking the first of forceable rape, a rape test will determine if the girl had sex or not. Then it depends if she says it was consentual or not. If it was consentual, your gangster friend might have ground for slander and defamation of character against the father.





In the second, you'll have to look up age of consent in the state your friends live in.





My opinion is that the girl's father simply doesn't want your gangster friend hanging out with his daughter. I think he's going a bit overboard with a rape accusation, but your friend ought to be aware of the laws and think about how it would look in court.
Seeing as in that case the girl likes the gangster I would think she would testify that it was consensual. That kills the lawsuit.





But if she does say it's rape your friend is screwed. An accusation of rape is the same thing as a conviction.
